TMZ has obtained a lawsuit filed by Kim Kardashian against Vivid Entertainment over the distribution of her sex tape with her ex-boyfriend, singer Ray-J.
The lawsuit, which cites "violation of right to privacy" and "right of publicity" was filed today in Los Angeles County Superior Court.
In a statement to TMZ Kardashian says, "This tape, which was made three years ago, and was meant to be something private between myself and my then boyfriend is extremely hurtful not only to me, but to my family as well. I am filing legal charges against the company who is distributing this tape since it is being sold completely without my permission or consent."
TMZ spoke to Vivid Entertainment Co-Chairman, Steven Hirsch, who said, "We are very confident in our legal position."

Kim Kardashian wants to set the record straight. When news broke last week that Vivid Entertainment was planning to release a sex tape featuring her and her ex, singer Ray J, conspiracy theories surfaced that she was secretly in on the deal.
But when Usmagazine.com caught up with Kardashian at Justin Timberlake's pre-Grammys party Friday night in L.A. she called those rumors "ridiculous."
"It's really hurtful to me and my family and, contrary to rumors, it's all happening against my will," Kardashian, 26, tells Usmagazine.com exclusively. "I'm sure any woman can understand what it feels like to be betrayed like this. I'm exploring all my legal options."
Kardashian showed her disgust with her ex the next night at the House of Hype party at the Hollywood Roosevelt Hotel, where Kardashian hosted a pre-Grammys bash. Sources tell Us that Ray J arrived at the bash driving a brand-new $300,000 Lambourghini convertible. and when Kardashian learned he had arrived she bolted to hide in a poolside cabana.
"She refused to come out until he left," says an Usmagazine.com tattler at the party. "She demanded security remove him, and they did."
Kardashian, a fashion and style entrepreneur who owns the Dash clothing boutique in Calabasas, California, is in Las Vegas this week at the MAGIC fashion trade show promoting Christopher Brian casual wear in her role as brand spokesperson.

Despite Kim's pending lawsuit, Vivid Entertainment is going forward with a March 21 release of "Kim Kardashian Superstar" -- the sex video Kim made with then-boyfriend, Ray-J.
Steven Hirsch, Co-Chairman of Vivid, told TMZ, "I met with Kim yesterday and unfortunately, we didn't even come close to reaching an agreement. We will now immediately move forward with the release."
After Kardashian filed suit last month, Vivid announced that they would temporarily halt production. The company feels confident that they have a legal right to distribute the DVD of the video. They paid an unidentified third party $1 million for rights to the tape, which was made three years ago.
Vivid promises a new preview clip will be available next week on www.kimksuperstar.com.
Despite the lawsuit, Hirsch tells TMZ he is still a huge fan of Kim's. "Kim has all of the qualities that we look for in a Vivid Girl. She's both beautiful and well-spoken which is a rare combination. In fact, if she was a Vivid Girl I might have cast her as 'Debbie' in our 'Debbie Does Dallas...Again' TV series.
